Terms and licenses

1. Scope

These terms apply to all contracts between Erdem Misir ("YUANFEN", "I") and customers about (a) digital products from the store (assets), sold through Payhip, and (b) custom work, for example Island Trailer, Custom Creature, Island Review, streamer maps, UI, game systems, 3D models and code. A consumer is anyone who orders mainly for private purposes; a business acts for a trade or profession. Other terms of customers only apply if I agree in writing.

For Island Trailer and Custom Creature, the order terms linked on the product page also apply; for other custom work, the terms in your offer. Where they differ from these terms, the order terms or the offer take precedence.

2. How a contract is made

Store: the store pages are not a binding offer. The contract is made when you complete the checkout at Payhip.

Custom work: after your request you get an offer with scope, price and date, on Discord or by email. The contract is made when you accept it or order the option at Payhip. Contract languages are English and German.

Ordering at Payhip: you put products in the cart or open the checkout of an option, enter your email and country, choose a payment method and send your order with the button at the end of the checkout. Until then you can check and correct every entry and remove items. Payhip stores your order and sends you the order data by email; I do not keep a separate copy of the contract text for you. These terms are always on this page, where you can save or print them.

3. Prices and payment

Prices are final prices; as a small business (§ 19 UStG) I charge no VAT. Only for buyers in the United Kingdom, the USA and Canada does Payhip add the tax due there (UK VAT or sales tax); you see the total before you pay.

You pay at the Payhip checkout (card, PayPal and other methods shown there) or by invoice as stated in the offer. Bigger projects can have a deposit, for example 50% for streamer maps, the rest on delivery. Express costs extra and only applies if agreed.

4. Delivery

Store downloads are available right after payment through the download link from Payhip.

Custom work is delivered by the agreed date as a download link or, for reviews and calls, as agreed in the offer. If material or feedback I need from you arrives late, the date moves by the same time.

We talk and I deliver in a private project room on my Discord server; large files come as a download link in the room. After the project is finished, the room and its files stay readable and downloadable for 90 days. I remind you 7 days before they are deleted; then they are deleted. Please save your files yourself.

5. Changes and your part

The number of change rounds is stated in your option or offer; more changes are possible at an agreed extra price.

You send what I need in time (for example island code, logo, references). You confirm that you may use the material you send me, such as logos, images, music or characters, and that it does not infringe the rights of others. I use it only for your order.

6. License for store assets

The copyright stays with me. With your purchase you get a simple (non-exclusive), non-transferable right, unlimited in time and place, to use and modify the assets in all of your own islands and games and in team projects you are part of, including publishing and monetizing them.

Not allowed: reselling, sharing or uploading the files, putting them in templates, map kits or other asset packs, and transferring or sub-licensing the license.

7. Rights in custom work

7.1 I am the author of the work I create for you (for example 3D models, animations, UI, Verse or Luau code, game systems, maps, trailers and graphics), and the copyright stays with me.

7.2 Once you have paid in full, you get a simple (non-exclusive) right, unlimited in time and place, to use, edit and publish the delivered work in the agreed project, including commercially and monetized, and in trailers, screenshots, ads and social media for that project. You may pass this right on to team members and publishers of the project.

7.3 Not included: selling or passing on the work as separate files, assets, templates or packs, or using it in other projects, unless we agree on it.

7.4 I may keep using, editing and developing the work, its parts and my code, and offer it, also in adapted form, to other customers or sell it as a product. This does not apply to anything that belongs to you or identifies you: your material, logos, brands, names, characters, texts and story. I remove or replace those first. A creature, character or world designed from your idea or description counts as yours: I do not sell or offer it to others; I only reuse the techniques, rigs, animations, code and generic parts behind it.

7.5 Exclusive rights: if you need the work exclusively, so that I do not reuse it, we agree on this in writing before I start, at an extra price. You then get an exclusive right of use. I may still use general know-how, techniques and building blocks I had before.

7.6 Portfolio: I may show the work (images, videos and a short description) in my portfolio, on this website and on my social media channels once your project is public, at the latest 60 days after delivery, unless we agreed on a later date or on confidentiality. I only name you if you want.

7.7 Content from Epic Games, Roblox or other third parties (for example platform assets, features or fonts) is subject to their own terms. I only use parts I am allowed to use.

7.8 Until you have paid in full, you may use the work only to check it.

8. Island Review and calls

What a review includes is stated in the chosen option. Calls take place on Discord. My findings are recommendations; you decide what to build. The bonus mechanic is covered by section 7.

9. Platform rules, no promised success

You publish your island or game yourself, under the rules of Epic Games (for example the Fortnite Island Creator Rules) or Roblox. I do not promise approval by a platform, plays, rankings, Discover placement or earnings.

Revenue share for streamer maps is agreed in a separate written contract.

10. Warranty

The statutory rights for defects apply. If something does not work as described, write me and I fix it.

11. Liability

I am liable without limit for intent and gross negligence, for injury to life, body or health and under the Product Liability Act. For slight negligence I am liable only for breach of an essential contractual obligation (an obligation whose fulfilment makes the contract possible and on which you may rely), limited to the damage that is typical and foreseeable for the contract. Otherwise my liability is excluded.

12. Right of withdrawal

Consumers have a right of withdrawal as described on the withdrawal page, where you can also withdraw online.

13. Applicable law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers this choice of law does not remove the protection of mandatory rules of the country where they live.

I am neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
